Decisions of the Office

Once an application has been made for an RCD, it is possible for the OHIM to refuse registration because it does not correspond to the definition of a design or it is contrary to public policy or to accepted principles or morality. The application could be also rejected if the applicant fails to overcome deficiencies communicated during the examination procedure.After an RCD has been registered, a third party can apply for a declaration of invalidity of an RCD to OHIM. The Office will decide on the invalidity. Such a decision may be subject to an appeal. Each party can file an appeal against the decision at the Office within two months of the date of the notification of the decision.
