The Trademark 5 (TM5) is a renewed institutional cooperation mechanism extended from the Trademark Trilateral forum in 2012. The group is composed by the original Trilateral members, the Japan Patent Office (JPO), the Office for Harmonization in the Internal Market (OHIM), the United States Patent and Trademark Office (USPTO) as well as two new members, the Korean Intellectual Property Office (KIPO) and the State Administration for Industry and Commerce of China (SAIC).
The TM5 members meet annyally to discuss projects and topics of mutual interest that aim to benefit trade mark filers worldwide. The fundamental objective is the harmonization of working methods, procedures, and practces that aim to ensure that applicants do not encounter divergent criteria when filing trade marks at the respective offices.
The TM5 are currently working on the projects contained in an Overall Work Plan, where a new project methodology approach has been designed to accelerate the development of the collaboration projects.
OHIM will be the secretariat of the annual meeting in 2012 which is scheduled to take place on 30-31 October 2012. Representatives from the World Intellectual Property Organization (WIPO) will be invited as observers in addition to representatives from user associations.
