Once an application has been made for a CTM, it is possible for the OHIM to refuse registration on absolute grounds. Applications may also be opposed, after publication, by a third party holding relevant earlier rights. After the CTM has been registered, a third party can apply for its cancellation. The OHIM will then decide on the cancellation. This decision may be subject to an appeal. Each party can file an appeal against the decision at the Office within two months of the date of the notification of the decision.
