3.1 What is the OHIM's fee for the registration of a CTM, in which currency must it be paid and when?

What is the fee?

For the registration of a Community trade mark, there is a unique fee to be paid:

Basic fees:

  • EUR 900 to file online (e-filing)
  • or EUR 1050 if you use the paper form

In either case, if your application covers more than three classes of goods and services there is a fee of EUR 150 for each additional class.

In which currency should it be paid?

The fee must be paid in euro. Payments made in other currencies are invalid and will entail loss of rights.

When must the fee for a CTM be paid?

The basic fee must be paid within one month of the date of submission of the application in order to obtain the receipt date as the filing date. The payment must be made to one of the Office's two bank accounts within one month.

The date on which any payment shall be considered to have been made to the Office shall be the date on which the amount of the payment or of the transfer is actually entered in a bank account held by the Office. Deemed date of payment (see Article 8 of the Fees Regulation).

If you miss the one-month deadline to pay the application, your application will not be refused but the filing date will no longer be the date of receipt of your application but the date of receipt of the payment

The OHIM will not issue a request for payment. If confirmation of receipt of payment is required, a request must be sent by fax for the attention of the Finance Department (+34.965.131.344).

3.2 How can fees be paid?

Credit card:
If you file an application electronically, payment by credit card is the recommended method for most users, unless they are regular or heavy users of the CTM system. Payments by card avoid the extra charges that banks normally make for cross-border payments, and they allow OHIM to make the best use of automatic internal systems, so that we can begin work on the file more quickly. Credit card payment is only possible at the moment of filing an on-line application.

Payment by credit card is not yet possible for all OHIM services, but we are extending the system so that, in time, it should cover most of them. To pay by credit card, you must provide some essential information. The information you disclose will not be stored by OHIM in any permanent database. It will only be kept until it is sent to the bank. You can safely enter your entire credit card number via our secure server, which encrypts all information submitted. You must select the credit card that you wish to use for payment. Currently, OHIM accepts payments via VISA, MasterCard and EuroCard.

You must also provide your 16-digit credit card number, as well as the expiry date of your card. The credit card number, as explained, will not be stored after sending it to the bank. Any record of the form will only include the credit card name (VISA, MasterCard or EuroCard) plus the last four digits of the credit card number. You must also include your credit card Security Code.

This payment option is only available at the moment of submitting the application but not for delayed payments (within one month from the date of filing).

* Some computer programmes do not accept the last three digits XXX of the BIC code. Should this be the case, users must indicate BBVAESMM or CAIXESBB.

** It is important to make the transfer indicating OUR as the method of payment for the bank charges in order to allow full reception of the amount . However, if you are making a SEPA payment, then the default SEPA specification “SHR” is required. SEPA is a new common European payments system, utilised by most banks in all 27 EU Member States and 4 additional European countries .

Current account with OHIM
In addition, it is possible to open a current account with the OHIM from which all fees payable by the holder of the current account will be debited automatically unless instruction is given in writing not to debit a particular fee.

3.3 How can I open a current account at the OHIM?

3.4 How does a current account operate?

The OHIM will automatically debit all fees and charges which become due for procedural acts (applications, requests etc) made by the holder of the current account. When debiting of a current account takes place, the fee is deemed to have been paid on the date on which it should have been paid.

The minimum amount required to open a current account is €3 000.

 


3.5 Is it advisable to open a current account at the OHIM?

Yes, at least if you are a regular user of the CTM system. The main advantage of the current account system is that you will be able to file applications and requests which are subject to time limits, such as oppositions or appeals, on the very last day of the time limit by fax with the result that the payment will be deemed to have been made on that day, provided that the current account has sufficient funds. The date on which the current account is actually debited will usually be later, but payment will be deemed to have been made on the date on which the application or request is received by the Office.

 

3.6 Can I make payments, or send documents other than CTM applications, to a national office of a Member State of the European Union, which will then forward the documents to the OHIM?

No, this is not possible. Any documents, other than the initial CTM application, and any payment of fees must be sent to or effected directly at the OHIM.

 

3.7 I just missed the one-month deadline to pay the application fee. Will my application be refused?

No, but the filing date will no longer be the date of receipt of your application but the date of receipt of the payment.
 

 

3.8 I missed both the one month deadline to pay the application fee and the further deadline set by the Office to pay the application fee. Can I still proceed with the payment?

No, the file will be closed and you have to send an entirely new application.
 

 

3.9 I need to withdraw my CTM application. Will the fee be refunded?

The CTM fee falls due with the application and no fee that has become due will be refunded.
