Glossary of Statuses for Community Designs
 
 

1. REGISTERED AND PARTIALLY PUBLISHED (part A.2 of the Community Designs Bulletin)

A design changes to this status when it has been entered in the Registered Community Design (RCD) register and has been filed with a request for deferment of publication. In this case only limited information is published online in the Bulletin and in RCD-ONLINE. The representation of the design is not published. The design may remain in this situation for up to 30 months.

2. REGISTERED AND PUBLISHED (part A.1 of the Community Designs Bulletin)

After the design has been entered in the RCD register and provided that either no request for deferment of publication has been made or the applicant has asked for full publication of a deferred design within the deferment period, the design will be prepared for publication. The representations of the design and all other relevant information are then published online in the Bulletin and in RCD-ONLINE. The design is protected for 5 years from the date of its filing.

3. LACK OF EFFECTS

If the applicant fails to request the full publication of the design and to pay the publication fee before the end of the deferment period, the RCD will be deemed from the outset not to have had the effects specified in the Community Design Regulation. The design will never be fully published.

4. DESIGN SURRENDERED

A design changes to this status when the holder surrenders his/her design.

5. INVALIDITY PROCEDURE PENDING

An application for a declaration of invalidity of an RCD has been filed against that specific design. This invalidity request will be examined.

6. DESIGN DECLARED INVALID

Following an invalidity procedure, the RCD has been declared invalid with effect for the whole Community. However, the RCD still appears in RCD-ONLINE.

7. DESIGN LAPSED

The term of protection of the RCD has ended and the RCD has not been renewed. Thus, the design has lapsed. The design still appears in RCD-ONLINE.

8. DESIGN RENEWED

The RCD has been renewed and is protected for a further period of 5 years. The expiry date has been updated.


STATUSES RELATED TO RENEWAL

1 Need to renew communicated

A notification of expiry has been issued to the representative of the RCD owner or to the RCD owner if no representative is on record.

2 Renewal application received

The OHIM has received an application for renewal of the RCD.


3 Renewal fee paid

A renewal application has been received and payment has been confirmed.

4 Renewed

The renewal of the RCD has taken effect.

5 Lapsed

The RCD has not been renewed and has therefore lapsed.
