Statuses for Community Trademarks
e-Search Plus offers basic and advanced search facilities to access OHIM's published information relating to Trade marks and Designs, as this information becomes available. Information is updated daily.


The basic search Search function offers a google style search of OHIM's
published information relating to Trade marks, Designs and their Applicants and
Representatives.
Enter the term you wish to search and click on Search. There is no need to use capital letter or accents. You may also search using numbers.

An overview of search results is displayed.
To view the results, click on
to expand the section you wish to
see in greater detail: Trade marks, Designs, Owners or Representatives or click
anywhere in the appropriate blue box.
When many search results are returned, you may jump to a subsequent page or scroll through results pages using the navigation bar. The navigation bar is shown at the top right and bottom right of the Search results.

Search preferences are “sticky” meaning that the same format will be shown next time you access e-Search Plus (unless you delete cookies).

You may limit the Basic Search to exclude certain information. If you wish to retrieve information on Trade marks and exclude information on Owners and Representatives and Designs that may contain the same keyword, uncheck those boxes leaving only the Trade marks box checked.
Remember also to uncheck the Everything box.

Although the Basic Search function accesses the same information as Advanced Search, it only searches the following fields:
If the Trade marks check box is marked, the following fields are searched:
· Trade mark number
· Trade mark name
If the Designs check box is marked, the following fields are searched:
· Design number
· Verbal element
If the Owners check box is marked, the following fields are searched:
· Owner number
· Owner name
And if the Representative check box is marked, the following fields are searched:
· Representative number
· Representative name
· Representation organisation
The Basic Search does not return Daily Publications or Case Law related information.
If too many results are returned using the Basic Search, or you wish to search using specific criteria, use the Advanced Search.
To search the entire Trade marks, Designs, Representatives and Owners database, leave the search field empty and click on Search.
Advanced Search is a customisable search engine. Users can enter more specific criteria, such as a filing date or a designer's name.
You can search specifically for Trade marks, Designs, Representatives, Owners, Daily Publications or Office Decisions (Case Law) by clicking on the appropriate tab.

Within each tab, the search function works in the same way.
Enter your search criteria and click on the Search button
Scroll down to
see results.
If you wish to reset the search fields, use the Clear button
Common search criteria include Trade Mark and Design names, numbers and type, Owner and Representative details or classifications and codes.
The following search options are shown by default (under the Trade mark tab):

You can narrow a search using AND if you want two or more criteria to be met.
Similarly, you can widen a search using OR.
If too many search criteria are shown, click
on
to
remove criteria.
To add specific criteria, go to the Most used Criteria or Additional Criteria sections and simply click on the criteria. The criteria are added to the active search criteria in the upper section of the screen.
The same criteria can be added more than once to allow more specific searches.
The following example searches for information on all Trade marks that are protected under Nice classification 3 or under Nice classification 5 and have the International Registration status of accepted or renewed.

· Trade mark number
· Trade mark name
· Owner's reference
· Vienna codes (for Figurative, 3D or Colour Trade marks) can be consulted on www.wipo.int
· Owner number
· Owner name
· Representative's ID number
· Representative's name
· Nice Classification
· Goods and Services
· Trade mark type
The following additional search criteria are available:

· Trade mark basis, to limit search to Community trade marks only or International applications and International registrations.

· Trade mark status (IR)
· Acquired distinctiveness
· Filing date
· Registration date

There are two ways to search for a Trade mark which as two or more Vienna codes.
To search specifically for a Trade marks that have Vienna codes that begin with category 03 and division 01 AND category 11 and division 03, enter the shortened Vienna codes 03.01.* and 11.03.* in separate search fields.

To add the Vienna search field twice, click first on Most used Criteria, and then on Vienna codes.

If you put both Vienna codes in the same field, many results will be returned. The first ones shown will have Vienna codes 03.01* AND 11.03.*. Later results will feature only one or the other Vienna code.

The most used search criteria are:
· Design number
· Verbal element
· Locarno class number (with a link provided to consult numbers)
· Indication of the product
· Owner number
· Owner name
· Representative's ID number
· Representative's name
· Designer number
· Designer name
The following additional search criteria are available:

· Design status
· Filing date
· Publication date
· Expiry Date
· Priority date
· Priority country

Use this option to find a Representative when you know a specific detail, such as Representative's Name or ID Number.
Click on Advanced Search and select the Representatives tab

Search criteria can be:

Representatives’ relationships can be traced. This may be useful to see which representatives share a Representative organisation.
The following example we shows a Representative linked to the organisation Cabinet Harle et Phelip.

Clicking on the Party ID number reveals other Representatives who are related to this entity:

For example, if you regularly search using Representative's ID No or Representative's name, you may wish to remove the other search criteria.
Note that in the following example, the pulldown has been changed to show OR.

To add specific criteria, scroll down to the Most used Criteria or Additional Criteria sections and simply click on the criteria you wish to include in the search. This criteria is added to the active search criteria in the upper section of the screen.
The same criteria can be added more than once to allow more specific searches.
The example below searches for Representatives from United Kingdom OR from France AND who are called Albright.

When the User clicks on the Search button, e-Search Plus will display the
details of all Representatives whose ID number contains 242 AND who are either
Lawyers OR Professional Representatives.

Click on the Representative's name to see further details, relationships or any associated Trade marks or Designs.
Use this option to find an Owner when you know a specific detail, such as Owner name or number.
Click on Advanced Search and select the Owners tab

Click on the Owner's name to see further details and any associated Trade marks or Designs.

Users who have traditionally consulted Bulletins may now choose how to see entries in CTM or RCD Registers (applications, registrations, later entries such as amendments and transfers, renewals, etc.)

i. Click on the Trade marks or Designs tab
ii. Under Publication date, choose the date range you wish to search

iii. When searching Trade mark publications, you can specify in which section of the Bulletin you wish to search
iv. Click on Search
Trade mark searches present a summary of the results found in the following format:

From this view, users can immediately access Publications (in the upper section).
Publications are listed in each Trade mark and Design. Click on the Section (shown below) to see the entry. Entries that Trade marks that pre-date October 2003 are not available.

1. Under Advanced Search, Click on Daily Publication.
Bulletins may contain a significant amount of information and take a long time to download. If this is the case, save a copy of the document before opening it.
Download the Index to see an overview of:
◦ Owner / Mark / Filing number (Index I)
◦ Mark / Owner / Filing number (Index II)
◦ Nice classification / Filing number (Index III)
◦ Filing number - registration number / Part (Index IV)

Using the pulldown menus:
i. Select CTM or RCD
ii. Choose the year of the Bulletin or Index you wish to consult
iii. Select the Bulletin (ordered by date and issue number)
iv.
Click on the icon
to download the chosen Index
v. Choose the Bulletin language
vi.
Click on the icon
to download the chosen Bulletin
Trade mark related decisions such as Refusals, Opposition and Cancellation decisions and Board of Appeal decisions can be searched using the Office Decisions tab.
The Office Decisions tab also provides access to General Court and Court of Justice judgements relating to Trade marks.

Many search options are available under this tab, which makes it highly recommendable to customise the Search Criteria used.
i.
Remove any Search Criteria that you do not use by clicking on the click

ii. To add further criteria, hold the mouse over Most used Criteria, Refusals, Oppositions, Cancellations or Appeals to see which further Search Criteria are offered. Click to add the chosen criteria

iii. Choose whether you wish to search all kinds of Decision. If you want to exclude, for example, Oppositions and Cancellations, uncheck those boxes

Users working specifically with Oppositions may choose to configure the Office Decisions screen as follows:

Access is given to documents made available by other courts


A summary of the search results precedes the actual results (for Trade mark and Design searches):

The summary shows how many Trade marks or Designs meet the search criteria and also offers a further breakdown to show details.
The example highlights how many Trade marks have been Registered and how many Registrations have expired. Users can navigate directly to these Trade marks just by clicking. By clicking for example on Registered, that criteria is added to the active Search criteria.
Trade marks that meet the Search criteria are shown directly below the Summary:

Click on the name of the Trade mark or Design you wish to see in further detail.

Full results are shown.

Click on Expand all to show detailed information. Click on Collapse all to hide sections. Click on individual sections to Expand (reveal detailed information) or Collapse (hide detailed information).
Drag sections you frequently refer to to the top of the screen.

Owners and Representatives can view their complete dossiers with ease.
1. From the Representatives or Owners tab, enter name or number
2. Click on Search
3. Click on link to Representative or Owner
All of that Owner’s or Representative’s Relationships, Trade marks and Designs are listed.
4. Click to expand the section you wish to consult

If the full name of the Trade mark is not known, wildcards can be used.
· The asterisk (*) is a wildcard that stands for any combination of letters.
· The question mark (?) substitutes any one character.
An Advanced Search for “kle*” under Trade mark name returns all the trade marks names contain a word which begins with kle, for example Kleen Peel and Calvin Klein.
An Advanced Search for “kle*” under Owner name returns a completely different set of results.
Searching for “*kle” under Trade mark name returns all the trade marks names which feature a word which ends in “kle.”
Searching for “*kle*” under Trade mark name returns all the trade marks names which feature this combination of letters anywhere in the word.
Using wildcards when searching Goods and Services will search in all languages and may return more results than are manageable.
Autofill is activated on name and code fields to assist users
When pulldown boxes contain long lists, as is the case with countries, begin typing the first letters of your chosen country. Available choices are presented in alphabetical order.

e-Search Plus can be installed as a search engine and displayed to the right of the navigation toolbar to give users easy access to e-Search Plus' Basic Search function.

Statuses for Community Trademarks
Application Filed
An application for a Community Trade Mark (CTM) has been filed within the Office.
Application under examination
Application is currently under examination process.
Application Published
The CTM application has been published in Part A of the CTM bulletin.
Registration Pending
The application is in the process of being registered. If everything is satisfactory the registration will be published in Part B of the Trade Mark Bulletin.
Registered
The Registration of the CTM has been published in Part B of the Community Trade Mark Bulletin
Application Withdrawn
The applicant has decided not to proceed with the CTM application.
Application refused
The application was not accepted during the examination phase. The refusal could have been based on formalities, classification or absolute grounds.
Application opposed
One or more oppositions have been filed against the CTM Application.
Appeal pending
An appeal has been filed against a final decision and the case is being dealt with by the Boards of Appeal.
Registration Cancellation Pending
A cancellation request has been filed with the Office against a registration of a CTM. The cancellation can be based on bad faith, on absolute grounds or on relative grounds. The examination of the merits of the cancellation may take some months.
Registration Cancelled
The request for cancellation was successful and the CTM is cancelled.
Registration Surrendered
The CTM has been surrendered in respect of some or all of the goods or services for which it is registered.
Registration expired
The CTM has not been renewed and has expired.
Statuses for International Registrations designating the EC
International registration received
An IR designating the EC has been notified by WIPO to the OHIM.
Formalities check
The examiner checks that a second language has been indicated, examines seniority claims and verifies the payment of fees. He proceeds to carry out searches pursuant to Article 39 CTMR.
Absolute grounds check
The examiner carries out examination on absolute grounds for refusal.
Absolute grounds OK
The IR designating the EC has been examined on absolute grounds and no objection has been raised.
International registration refused on absolute grounds
The IR designating the EC has been definitively refused due to the existence of absolute grounds for refusal. The applicant cannot appeal against this decision as it has become final.
International registration refused on formalities
The IR designating the EC has been definitively refused due to formalities deficiencies. The applicant cannot appeal against this decision as it has become final.
Opposition pending
The IR designating the EC has been opposed based on one of the earlier rights foreseen in Article 8 CTMR.
International registration refused on relative grounds
The IR designating the EC has been definitively refused due to successful opposition. The applicant cannot appeal against this decision as it has become final.
International registration accepted
The IR designating the EC has been definitively accepted.
IR decision appealed
An examination decision refusing the international registration designating the EC been appealed before the Boards of Appeal.
Removed from the register
The IR designating the EC has been removed from the International Register.
Statuses for Registered Community Designs
Registered and fully published (A1)
After a successful examination of the application and payment of appropriate fees, the Community design is registered and published in the Community Designs Bulletin. Renewed Registered Community Designs (RCDs) and RCDs published after a requested deferment period also appear with this status. RCDs are protected for a five year period. Protection can be renewed four times.
Registered and subject to deferment (A2)
When an RCD applicant so requests, publication of sensitive information can be deferred for up to 30 months. Such an RCD application, which meets the criteria of formal examination and is accompanied by payment of appropriate fees, is published in part.
Lack of effects
If the applicant does not request publication of the design, or does not pay the publication fees before the end of the deferment period, the design will never be fully published. It is deemed to lack the effects specified in the Community Design Regulation.
Design surrendered
An RCD owner officially communicates the wish to surrender a design. The surrender comes into effect when entered in the Register.
Invalidity procedure pending
A reasoned application to declare an RCD invalid has been received. The OHIM is examining whether the grounds adversely affect the RCD being maintained.
Design declared invalid
After examining the invalidity claim, the OHIM declares the RCD invalid.
Design lapsed
The 5 year protection period afforded by registering the RCD has come to an end and has not been renewed. The expiry date is shown.
